General Terms and Conditions

Hotel Stadt Tuttlingen MSC GmbH is committed to offering its customers a professional service. To this end, it is necessary to agree clear rules and arrangements between our customers and the hotel in order to prevent any misunderstandings.
1. Scope:
1.1. These General Terms and Conditions apply to contracts for the letting of hotel rooms for accommodation purposes and to all other services and supplies provided by the hotel to the customer in this connection (accommodation contract). The term “accommodation contract” encompasses all terms associated with the booking of one or more hotel rooms.
1.2. Provisions deviating from these General Terms and Conditions shall apply only if agreed upon with and confirmed in writing by Hotel Stadt Tuttlingen MSC GmbH.
2. Conclusion of contract: An accommodation contract between the customer and Hotel Stadt Tuttlingen MSC GmbH is concluded upon acceptance of a booking made in writing (e-mail), by telephone or in person, and upon delivery of the booking confirmation, which is sent exclusively by e-mail. These General Terms and Conditions form the basis of this contract.
3. Joint and several liability: Where a third party concludes a contract on behalf of a guest or a principal, that third party shall be jointly and severally liable to the hotel, together with the guest, for all obligations arising from the hotel accommodation contract.
4. Services:
4.1. The hotel is obliged to keep the rooms booked by the customer available and to provide the agreed services.
4.2. The customer is obliged to pay the agreed prices or the hotel’s applicable prices for the provision of the rooms and for any other services used by the customer.
5. Check-in / Check-out:
5.1. Hotel rooms are available to the guest from 15:00 on the day of arrival and must be vacated by 11.00 at the latest on the day of departure. Thereafter, owing to the late vacating of the room, the hotel may charge for its use beyond the contractually agreed period 50% of the confirmed room rate until 18:00, and 100% of the confirmed room rate from 18:00.
5.2. Unless otherwise agreed in writing, the guest has no entitlement to the provision of specific rooms.
6. Prices: All our prices are stated in euros (€) and include the statutory value added tax of the Federal Republic of Germany.
7. Terms of payment: The invoice is to be settled on site in cash or by EC, Maestro, Master Card, VISA or American Express. Invoices on account are due immediately upon receipt without deduction.
8. Cancellation of individual hotel rooms: The following conditions apply both to cancellations and to no-shows (failure to take up the booking) for the entire booking period, as well as in the event of late arrival or early departure.
8.1. Cancellation of 1 room is free of charge until 23:59 at the latest on the day before arrival.
8.2. Cancellations of 2 to 4 rooms are free of charge until 48 hours before arrival.
8.3. Cancellations of 5 to 10 rooms are free of charge until 1 week before arrival.
8.4. Cancellations of 11 to 20 rooms are free of charge until 3 weeks before arrival.
8.5. Cancellations of 21 rooms or more are free of charge until 4 weeks before arrival.
8.6. Cancellation after the periods stated above, no-show:
100% of the confirmed room rate for the entire booking period.
9. Cancellation of allotments or bookings of 21 rooms or more:
9.1 Changes or cancellations result in losses that we cannot bear alone.
Cancellations of group reservations or allotment reservations are valid only if received by us in writing.
Cancellation is free of charge until 4 weeks before arrival.
For later cancellations, we will charge 100% of the room rate for the entire stay.
In the event of a no-show or early termination of the stay, 100% of the room rate for the entire booking period will be charged.
10. Deposit for allotments: Hotel Stadt Tuttlingen MSC GmbH reserves the right to invoice a deposit of 50% of the total amount for allotment bookings. This advance payment is due no later than 10 days before the reservation is taken up.
11. Services not used:
Rooms booked definitively in advance or booked by name will be charged at 100%, even if they are not occupied by the guest on site. Example: later arrival / earlier departure. The same applies to services booked on site, such as half board, buffets or group menus.
12. Right of withdrawal of Hotel Stadt Tuttlingen MSC GmbH:
Hotel Stadt Tuttlingen MSC GmbH is entitled to withdraw from contracts if:
a) force majeure or other circumstances for which Hotel Stadt Tuttlingen MSC GmbH is not responsible make performance of the contract impossible or unreasonably difficult;
b) performance of the contract may permanently impair the business operations, the security or the reputation of Hotel Stadt Tuttlingen MSC GmbH, provided that this is not attributable to the hotel and occurred after conclusion of the contract or became known to Hotel Stadt Tuttlingen MSC GmbH after conclusion of the contract.
13. Liability of the hotel:
Hotel Stadt Tuttlingen MSC GmbH shall be liable – subject to clause 13.1 – only in cases of intent or gross negligence. Claims must be asserted against the hotel without delay; otherwise they shall be deemed forfeited.
13.1. Hotel Stadt Tuttlingen MSC GmbH shall be liable for damage resulting from injury to life, body or health insofar as such damage is based on a negligent breach of duty by its legal representative or vicarious agent.
13.2. For other damage, Hotel Stadt Tuttlingen MSC GmbH shall be liable only in cases of an intentional or grossly negligent breach of duty by its legal representative or vicarious agent.
13.3. The guest shall be liable for all damage to and in the hotel that he or she causes at least negligently.
13.4. Hotel Stadt Tuttlingen MSC GmbH accepts no liability for items belonging to the guest that are lost, stolen by third parties or damaged.
Clause 13.2. remains unaffected by this.
14. Smoking:
Smoking is strictly prohibited throughout the entire building. In the event of non-compliance, we reserve the right to impose a penalty fee of €250.
The guest shall be fully liable for any consequential damage.
15. Pets:
Pets are permitted only by prior arrangement with the hotel.
16. Place of jurisdiction:
The exclusive place of jurisdiction for all disputes arising from and in connection with supplies and services of Hotel Stadt Tuttlingen MSC GmbH is the town of Tuttlingen.
17. Final provisions:
German law applies exclusively.
